Temporary Judgeship at Common Ground

Unlocking the Potential of Temporary Judgeships by Stipulation

Many individuals may be unfamiliar with the concept of utilizing Temporary Judges through stipulation, yet it presents a valuable resource in the realm of civil litigation. Under the California Rules of Court (Title 2, Division 6, Chapter 2), parties have the option to stipulate to the appointment of a temporary judge for the adjudication of all or part of any civil dispute.

The key advantage of this process lies in its preservation of constitutional adjudication, distinguishing it from purely private determinations. This ensures the retention of essential rights, including the right of appeal or writ. While Temporary Judgeships are not commonly utilized due to the lack of suitable venues, Common Ground offers a solution with its dedicated hearing room setting.

At Common Ground, we facilitate Temporary Judgeships by providing all necessary services, including security, clerk’s minutes, and court reporting. This comprehensive approach ensures the preservation of a constitutional process. In fact, we actively encourage the use of Temporary Judgeships, even in mediated matters.

One notable application of Temporary Judgeships is in mediated disputes. By stipulating to a Temporary Judge, parties can seamlessly transition their mediation into a Mandatory Settlement Conference, as mandated by law. This strategic maneuver not only streamlines the process but also minimizes duplication of costs and expenses.

Moreover, at Common Ground, we ensure that parties and attorneys are afforded the same level of seriousness, substance, and weight as in a traditional trial courtroom. Additionally, in cases where a public courtroom is required, such as for jury trials, we are readily available to preside upon a showing of good cause.
